Very good question, and the answer is likely yes. If a citizen cannot be charged with violating criminal law by virtue of being the sitting president, that would create blanket immunity. If Trump wins, Zero Dark Brandon suddenly becomes a viable option.

My take is Biden wouldn't do anything, I can't see him going dark.
