Hvordan kan du erklære at konflikten overordnet set er folkedrab, hvis der ikke har været nogen juridisk proces på område, som har gjort det klart at der er tale om folkedrab? Jeg er personligt ikke arrogant nok til at tænke at jeg sidder med alle kortene på hånden til endegyldigt at bedømme en historisk og kompleks konflikt.

Derfor vil jeg personligt vente på at der har været en international juridisk proces, hvor beviser og krigens kontekst er blevet gennemgået, frem for at lade min egen personlige mening eller vindene på de sociale medier bestemme hvad det er.

Det har der. Den Internationale Domstol fandt det plausibelt at der begås folkedrab i Gaza:

"At least some of the acts and omissions alleged by South Africa to have been committed by Israel in Gaza appear to be capable of falling within the provisions of the (Genocide) Convention," the judges said.

The ruling required Israel to prevent and punish any public incitements to commit genocide against Palestinians in Gaza and to preserve evidence related to any allegations of genocide there.

Israel must also take measures to improve the humanitarian situation for Palestinian civilians in the enclave, it said.

The obligation to ensure respect by others

186 The obligation to ensure respect also has an external dimension related to ensuring respect for the Conventions by others that are Party to a conflict. Accordingly, States, whether neutral, allied or enemy, must do everything reasonably in their power to ensure respect for the Conventions by others that are Party to a conflict.

187 This duty to ensure respect by others comprises both a negative and a positive obligation. Under the negative obligation, High Contracting Parties may neither encourage, nor aid or assist in violations of the Conventions by Parties to a conflict. Under the positive obligation, they must do everything reasonably in their power to prevent and bring such violations to an end. This external dimension of the obligation to ensure respect for the Conventions goes beyond the principle of pacta sunt servanda.
