I mean the title question would be super illegal. The thing he did is probably fine if its in a bag and especially fine if he didnt hit anyone with it.

Throwing something at a person is battery, pretty much everywhere in the US.

You could also make an argument that it's "discharging bodily fluids" or some weird kind of "disturbing the peace" type of offense predicated just on disturbing other people around you, but it definitely would be battery.
