Names are not unique. You can have the same name as someone else and can have multiple characters with the same name.

IIRC character names don't even have to be unique inside a realm.

Pretty sure you don’t need a unique name. In D3 I always called my seasonal character for “Season” and just did a rebirth each new season.
I have multple characters with the same name
Have you not made a second character? Both of my characters have the same name. This is how Diablo has worked since D3.
Oh ok, I didn’t know that. I was so glad I was able to snatch my character names :D It does make sense though with only 16 players per lobby and having to interact to trade there isn’t much need for unique names.
Even if there were more than 16, they can do it. Your unique identifier is your battle tag. Your display name can be anything.
