Hello, we just moved here, and we waited to get an invoice to pay for March. The invoice never arrived, but on the 12th we got a warning that we are late and need to pay our rent in the next 14 days. They added 325dkk fine to the rent itself. They say they sent an invoice on 1.3 but we never got one. We paid the moment we saw the warning, is it legal for them to take an additional charge?

It is your responsibility to pay the rent. Even if the invoice is late. It is stated in your contract that the payment have to be made 01. If you don't know the amount, you can contact the administration. So in short, yes it is legal.

Understood.. No one explained to us that we are able to pay without an invoice, i thought every month the numbers we need to pay the invoice changes

Contact LLO, as reddit is absolutely terrible to get advise from in these cases.

LLO is the organization for tenants in Denmark.

If it is Houserent (?) you are responsible to transfer the money to the account specified in the contract on date. What do you mean by invoice here ? What does your contract say about payment ?

they cant take 325, the max is 100 kr

It’s a “Påkravsgebyr (LL § 182, stk. 2)” and not a reminder fee for late payment when it comes to rent. Which is set at 325kr for 2024. I believe it gets adjusted yearly.

So 325kr is perfectly legal. It’s max 100kr when it’s an invoice otherwise, say a car payment or other types of debt.

I'd contact them and ask - they're legally only allowed to tack on the fee if you actually received the first bill. Furthermore, the size of the late payment fee has a legal maximum, and 325 sounds a little to the high side, but I'm not sure if it's been inflation adjusted.

If they mail the involve there is an assumption of delivery even though that doesn't really make sense.

And pay on time on the next rent.

There really isn't more to do with it. Smile and wave, just smile and wave.

It's no excuse to be uninformed, so the amount if in doubt would be your problem to find out.
