Is it just me, or is tweeting about upcoming litigation just incredibly stupid… on both sides.

It’s just legal fodder for the lawyers / judge.

Wouldn’t really say it is stupid, especially if it highlights the proof of something. Besides, there’s nothing wrong with pointing out blatant theft and publicly calling them out.

Think of it as a legal tactic. When you've got them dead to rights, publicly turning the screws will pressure Casetify to quickly settle, which is what will end up happening. Don't be surprised if Casetify writes a check and this quietly goes away.

Settlements don't have to be silent, it could include requirements that Casetify apologizes publicly or admits wrongdoing or something.

Normally, I would agree with you. You want the defense to begin putting together their case when they receive the served papers. Giving them a heads up just gives them more time to prep.

But there's no way that dbrand and Zack would have done this without their lawyers' approval. This appears to be a slam dunk case and, by giving this type of heads up, it expedites the eventual settlement. No way this goes to a trial of any kind. Casetify knows they screwed up, and they will want this to go away as quickly as possible to minimize the harm to their brand.

My guess? We're going to get an undisclosed settlement, an NDA on all sides, and no admission of wrong doing on Casetify's part.
