We had some works done in our apartment by a company of two brothers: a tømrer and a vvs. About one year later during the night we hear some weird noises from another room, and when I go to see what's happening, the big hanging cabinet falls before my eyes, smashing the iMac under it. I would probably be dead if I was sitting at the computer, and even worse my baby could have died since we were about to move his bed in that room, one of those days.

We found out that the workers hanged the cabinets using some ridiculously small plastic pieces that were supposed to be used only to avoid roll-over, in case the cabinet were mounted on the floor. They were not made for supporting their weight. Back then, we provided them the correct Ikea metal pieces, but they said thet didn't need those, and we trusted them, thinking they used some custom tools they have, since this is their job.

Our insurance refunded us the Ikea cabinets (a few hundred kronas), but not the computer (which costed about 30k DKK but now is too old). We contacted these workers who are now part of another company, and they promised us to contact their insurance to refund us a bit of the computer at least, but now it is three months the tømrer doesn't even answer our emails.

On top of that we had a sewage problems that seems to be caused by the vvs installation, and the vvs one says we have to pay ourselves for it, but I have a feeling he is lying (and the building handyman says it's the vvs fault). But this is another story.

The thing is that these two persons have always been very gentle and nice in their manners, and we also are polite and understanding, but now we have the feeling that they are taking advantage of us.

I guess some people would sue them but I don't know if going to a lawyer is even the correct thing to do.

I don't even know what I want. But I had to buy a new computer and I will have to pay for a toilet repair that will be very expensive. On top of that I am a bit traumatized by that event. I feel there is something that is unfair here.

What would you do?

I can't see that written as a rule anywhere, though.

Seems to depend on which mod reads it and their mood on that particular day. Sometimes it has to be about Danish stuff (like Danish politics or whatever), and sometimes it's OK that it's just something that's happening to a person in Denmark.

You can look into a civil case (civilt søgsmål) but I dunno your chances.

Also, traumatized by your stuff getting ruined, and the same kinda hypotheticals about "Myself or my child could've been killed" that you can have about everything in life?

I have never been so close to an actual life threatening accident, this thing fell 50cm from my head and the computer exploded, it was quite a jumpscare. First world problem, I know.

You wrote that you COULD have been killed if you were sitting at the computer, and now you write that you were only 50cm from it falling down.

The same hypotheticals can be said about anything outside your door. "what if I was 50cm closer to the car driving fast past me?" "What if I had fallen into the hole that wasn't there yesterday".

Which is it? Were you close or not?

Your Honor, I was very close. I was not sitting at the computer but I was standing 50 cm outside of the radius of the falling cabinet. That very cabinet that was hanging at 2.10m high.

If there is a car going faster than the speed limit and not respecting pedestrians I want that car driver to be fined, regardless of the fact that he killed or not a baby.

If there is a hole on a path I want the hole patched before someone gets injured.

What are you talking about?

It was held by the mounting brackets on the side (the cabinet was attached to a wardrobe on one side) and it is incredible that they lasted so much, but the main part that was supposed to hold the weight was a wrong piece, they also admitted.

I think at this point you might have to go through courts. I don't have experience with it, but it seems like you might be able to do it as a småsag since the damages appear to be under 50k. That way you can do it without lawyers.

If you persue the matter further; I would leave out the hypothetical scenarios and focus on what actually happened. IMO that would be the most culturally appropriate approach in Denmark.

The cupboard could actually have fallen down on your entire family, holding the most valuable items you own!

I understand. I was hoping that the hypotetical scenarios would have put the company in the mindset of "we fucked up big time, let's fix the other problem at least".

I anyways believe that mounting a cabinet with the wrong tools is a big mistake for one that does that as a job. Denmark has a wonderful system to prevent accidents from happening, just think about the smiley reports for food places. They don't fine because someone gets sick, they fine because someone might get sick.
