Hi, everyone. My mother is a Danish citizen living in Denmark. She just reached out to me and told me that she was sexually assaulted by her massage therapist today. He groped her breasts (including her nipples) and butt repeatedly while breathing in her ear and telling her how beautiful she is. She froze, because she was terrified in this situation, and now isn't sure what to do. I'm in America and am unfamiliar with Danish laws. Can she report him to a kind of better business bureau or go to the police? What options do we have for making sure this doesn't happen to anyone else? Thank you so much for any insight you can provide!

Depending on where she lives there are different places to get support in such situation, e.g. help in contacting the police, information to relatives etc.

In the capital region it is here (they also list places in other regions on their page):

Your mother however can inform the police, and it's surprising that this is even a question. What kind of place did she visit?

In America you can contact the Better Business Bureau to file a complaint against the business and hopefully get their license revoked, which is why I was asking if there was anything similar in Denmark. She visited a massage/fitness center.

That's why I asked what kind of place. First she should contact the police. Secondly the fitness center (his place of employment).

There is no license required to be a massage therapist, and if he was self employed, it's a bit more difficult.

It's also the reason why I found it weird. As a massage therapist you are pretty exposed to complaints. You are easily replaced and black listed, and if self employed you live off your reputation. Obviously sick people exist.

Edit:

And a massage parlor in Denmark is often times legal prostitution. I have a Spanish friend that went wrong on that one, when he had som back spasms.

That makes sense. He is unfortunately the owner of the business, which means he has more power in the situation than if he were just an employee. I'm shocked he would risk his reputation like this too.

I will say that unless she has proof it is hard to get someone punished for sexual assault because you need evidence, I had a SA case and it didn’t even go to court despite the fact that everyone were sure he did it cause i didn’t have any proof other than my testimony, unless he confesses of course but that’s unlikely. You should definitely still report it but just be aware of this

I agree that it could and should be A LOT better here in Denmark, but still it is important to report sexual assault - every time! If we stop doing that, then the disgusting creeps have won for good.

Do not worry about any financial problems for your mother. It will not cost her any money, no matter how far the case goes. That’s for sure.

My best advice is to make sure she takes another person with her, when she goes to report it. In my experience officials make more of an effort if there are several people in the room. Same goes with doctors etc.

Also, she should get a confirmation in writing, that she has reported him to police. If she chooses to contact the organization for massage therapist (I forger the name), then she should also send that in writing and ask to get written confirmation that they received her complaint. Documentation is important!

In general, you don't have to get a lawyer or pay anything when you report a crime, no matter if you're the victim or not.

Edit: also, the police will question other customers to get multiple testimonials. If no one else has been molested by him, she might not get justice (word against word situation).

Don’t be concerned about that. The police will guide you through it. I’m pretty sure it will only cost you some time, not money. But really, the police can guide you through it all. Don’t hold back with reporting this!!

I really fail to see how it could get expensive. She can press charges and if the police and the prosecutors office finds that there is a case that will hold up in court they will indict him. It really does not require anything on her part except providing police with the relevant information and probably testify in court. If it goes to court she can probably also submit a claim for damages against him as part of the criminal proceedings.

This is criminal matter, be aware that civil lawsuits are not as common in Denmark, so suing for damages etc. beyond what might be granted in a criminal case is quite rare.

Shit, I just read their trustpilot reviews.

I have a distant friend who went to a masseurs in cph and he tried to get his hands under her underwear. He said he must've misread the signs when she told him to stop.

She reported him to the police, they said it was a 'he said she said' case so they couldn't go any further with the report. Don't know if it was Txxxxx tho, but that girl who left the review is doing more to keep other girls safe than the police.

Eh, that is just how we structured our law. The accused has all the rights and are found innocent until proven otherwise. Police honestly can’t do much if no other person reported similar crimes.

First thing, she need to call the police. Next: Many Danish therapists are members of a professional organization. If he has a certification from any of these organizations, she can try to contact them and report the assault. It might not be the first time something like this has happened. If they find the accusation credible, they might be able to suspend his certification until the police have completed their investigation.

I recommend going to the police only. If your mom is unable to later prove the assault, it's not a good idea to involve other, non law enforcement parties. You don't want to risk her being accused of slander.

What happened to her definitely is illegal in Denmark, but the Danish police doesn’t always handle sexual assault cases very well. There has been a culture of distrust of women who report sexual violence, and even though the police have been trying to improve things, she might still meet an officer with an outdated view of sexual assault victims who might not treat her well. According to Danish law, you have the right to a “bistandsadvokat” - victim’s rights lawyer- if you are a victim of a “serious sexual assault”. I don’t know the exact meaning of the word “serious” in this context, and I am not sure if her assault qualifies, but IF it does, the government pays for the bistandsadvokat who can guide her through the process of reporting and go with her to the police station. She can try calling the local center for sexual assault at the hospital and get a list of recommended lawyers.

She won’t pay a dime, as far as I understand. Prosecutor is public. If she loses, the state covers it. If she wins, he has to pay the costs.
