I'll leave out all the extraneous details, but yesterday, my boss contacted me to say the business was officially closing and my last pay had been processed. Previously, my pay stub would come in the last few days of the month, and the pay itself on the 1st. As of today, I have received neither. Further, my boss did not respond to a question I had about my pay yesterday, nor are they responding to any messages today. Coupled with the fact that my boss has vanished from social media and texted me using a new phone number, the situation feels extraordinarily sketchy.

My understanding is that Lønmodtagernes Garantifond should pay my wages in this case; but should I be expecting that to happen automatically, or do I need to make contact? Further, my boss has historically been quite bad about tracking my hours accurately, so I do it myself and submit the hours to them each month. I did this last month and have screenshots of me submitting it to them, but is that sufficient evidence to get paid accurately?

Before it gets asked, I'm not part of any union. Tak for hjælpen!

You apply here:

They will pay what you are owed + three months of salary in most cases. At least what you are owed.

Don't use a union for this. They only slow down the process. If LG has any questions they have to go through the union and things will drag out.

People in here who yells unions are obviously just to lazy to read up on their own rights and God forbid they have to do a bit paperwork.

As you're not a part of a union, I'd try to reach out to the municipality office (guess you have to declare yourself unemployed as well)

If anything seems fishy (like let's say, you think your boss is running away), contact the police ASAP and let them know. So he doesn't sip on drinks in Dubai for your salary

It's not illegal to leave the country while undergoing bankruptcy, so I'm not sure why OP should contact the police?

The estate trustee (kurator) will find the missing money and claim it back for the estate and creditors.

If OP actually suspects wrongdoing, get in touch with the estate trustee, whose info can be found on statstidende.dk using the CVR of the firm.

I have all of this all prepared, so that's good. Thank you for the advice. Do you know if there's any waiting period before I submit my claim? As in, do I need to give my boss a few days to pay me, or can I go ahead with it now?

They cap at 160.000dkk, but brace ypurself because it can easily take 4-5 months to get the money. However you were member of a union then they would loan you the money intrest-free and just duduct each loan from the end-amount. You might wanna get a union going forward :)

It's pretty easy to apply for lønmodtagernes garantifond. You go to the website, find the number and call them. There is a form you need to fill out.

Are you part of an a-kasse? If so they can also help you out.

If not - you have to do it yourself - you will probably also be contacted by the bancruptcy estate (some lawyers), you need to tell them that you have not received your salary, so that they know.

You should make sure to claim any holidays that you already paid for but didn't spend, and if you had a... what's it called - a period of time after you were fired where you are still employed - like typically 3 months or so. You should also claim that salary. (yeah you messed up not being in a union ;-) )

I'm not familiar with an a-kasse, so I can't imagine I'm part of one. Looking it up, it looks like it's unemployment insurance?

I definitely messed up by not being in a union, for sure. I became the senior-most employee at the place almost immediately after starting, and it was my first job in Denmark, so I had very little information regarding unions or employee protections.

I didn't choose that at all, I have no idea who my union would even be; I've never been told anything about who the union is, I've never heard a co-worker mention the union, and this is the first job I've had since moving to Denmark. I would've loved to be a part of a union.

Ignore him. A union had nothing to do with this but could only provide you with the same answers as this thread has done - for this issue.

But for your next job talk to your 'tillidsrepræsentant' or 'arbejdsmiljørepræsentant' and they can probably guide you to the proper union. If not, ask on Reddit. In Denmark we have a strong union tradition which protects us from abuse, and bot being part of one can be seen as freeloading which is why you got such a hostile response.

Did not say the union had anything to do with his situation, but that he was seeking the help a union could provide. Didn't say the union could provide help besides what was given in this thread either. Hope your reading comprehension studies pays off.

I would look up what union i should be in! Call them and tell what happened and normally if you join up they will do most of the work with applying for your wage !!
